7 ENDORSEMENT
(INDORSEMENT) (индоссамент; передаточная надпись) 1. Надпись на оборотной стороне переводного векселя (bill of exchange) или чека, передающая право получить платеж по нему лицу, подписавшему его. Вексель может передаваться путем индоссамента неограниченное число раз; предполагается, что индоссаменты производились в том же порядке, в каком они стоят на ценной бумаге, следовательно, последним, кто указан в этом списке, является ее держатель, который должен получить платеж. Если на векселе был сделан бланковый индоссамент ( blank endorsed), т.е. неуказан индоссат, платеж получает предъявитель векселя. В случае наличия ограничительного индоссамента (restrictive endorsement) типа “заплатить только лицу X” вексель прекращает свое существование в качестве отчуждаемого финансового инструмента. Специальный индоссамент ( special endorsement), при условии, что указан индоссат, делает вексель оплачиваемым по требованию (to order) и состоит из короткой фразы “в соответствии с требованием...”. 2. Подпись, необходимая для того, чтобы документ приобрел юридическую силу. 3. Любые исправления, вносимые в страховой полис (insurance policy) или временное свидетельство о страховании в связи с изменениями в условиях страхования.
